Divorce
Listen as Justin breaks down the law and lets us know why it may appear that men get the short end of the stick when it comes to divorce proceedings. He clarified very early (and often) that the law isn’t “out to get men.” Rather, it’s an issue of who was the primary caregiver/breadwinner before the divorce that determines who continues to care for the children. He did acknowledge that there is a major disparity between the court vs spouses’ value of domestic labour.
Many do not know that a couple has to be separated for a year before a divorce can be finalized. Although adultery and (physical/emotional) harm are factors that can negate this, the ability to prove it is such is a long (and expensive) process. Lee suggests a year-long separation because it will likely yield the same results (without the added expenses). Speaking of lengthy and costly, Justin told us no one wins in court. He forewarned that “it is to your benefit, your family’s benefit, and the children’s benefit to settle outside of court.” If there is an impasse and settling is no longer an option, going to court is a last resort method.
Prenuptial Agreements
As the majority of the questions tend to surround the topic of prenups, Justin went into detail about the intricacies of prenuptial agreements and what can and cannot be included. He stated that there isn’t a situation where a couple shouldn’t get a prenup, but there are times when it may not be required.
